Delhi HC directs Oyo to furnish affidavit of unencumbered assets for Anam Datsec


NEW DELHI: In the matter concerning Oyo Hotels & Homes and hospitality company Anam Datsec, the Delhi High Court, through an order passed on August 20, directed Oyo to furnish a copy of the affidavit of unencumbered assets for petitioner Anam Datsec.


On receiving the affidavit, Anam Datsec is supposed to file an undertaking in court that the affidavit of Oyo’s unencumbered assets shall only be used by the company for the purpose of the proceedings and the contents shall not be divulged to any person not connected with the proceedings as a representative and counsel.


The order was passed in the contempt of court petition filed against Oyo, its founder Ritesh Agarwal and directors Rakesh Kumar and Anuj Tejpal in the Delhi High Court by Anam Datsec for not submitting a list of its unencumbered assets.


The Delhi High Court had asked SoftBank-backed Oyo on July 7 to file a list of its unencumbered assets within two weeks in the case filed by Anam Datsec citing non-payment of dues by Oyo for its Golden Sands property in Calangute, Goa, and seeking over Rs 8 crore in damages from the company.


According to the July 7 order, Oyo was supposed to submit an affidavit of its unencumbered assets along with its response to Anam Datsec and send a similar affidavit in a sealed cover to the registry.


Anam Datsec filed a contempt of court petition against Oyo as it claimed it did not get the affidavit of unencumbered assets. Oyo said it would not be able to provide any comments on the matter. Anam Datsec said it cannot comment on the matter as it is subjudice.
